The asset

Native currency of the Ethereum network (layer-1 smart contract platform, proof of stake) Issuer: No current issuer: issuance is set by the protocol. Initial public sale of ether in summer 2014 by the founding team; network launched in July 2015 by Vitalik Buterin and his co-founders.

Ether pays transaction fees (“gas”) on the Ethereum network and its applications, and secures the network through staking. Its supply is not capped: newly issued ether rewards validators, and part of the fees is burned.

Why this verdict

  1. Permissible purpose : met. Ether pays the fees of a general-purpose smart contract network and serves to secure that network; it has a real use documented by the network's foundation.

  2. No riba : met. Holding ether pays nothing in itself. Newly issued ether rewards validators, that is, those who deposit ether to activate a validator; this income comes from the protocol, not from a loan.

  3. No gambling : met. A spot purchase is of a token recorded on the blockchain, transferable and used to pay fees; it is not a contract on a price difference. The SEC and the CFTC classify ether among “digital commodities”.
  4. No excessive gharar : met. The issuance rules are published: uncapped supply, issuance for validators, burning of the base portion of fees. The 2014 initial sale announced its issuance plan and development reserves. The exact total supply is not stated in the pages read.
  5. Real ownership : met. Ether is held in a personal wallet that gives control of the account, and is transferred from account to account.

  6. No fraud or manipulation : met. No ruling or warning finds deception toward ether buyers; the founding team is public. The SEC closed its investigation into the status of ether in June 2024 without bringing charges. Caveat: the distribution by address could not be independently verified (see gaps).
